Netflix Victorious in 'Tiger King' Fair Use Copyright Battle

An appellate panel on Thursday reversed its previous stance, affirming that the inclusion of a 66-second video segment from a character's funeral within the documentary falls under 'fair use' protections. This ruling overturns an earlier 2024 decision by the same 10th Circuit Court of Appeals panel, which had initially sided with videographer Tim Sepi, who sued Netflix for using his footage without compensation. The initial judgment, influenced by a Supreme Court ruling on an Andy Warhol image, had raised concerns within the documentary community about the scope of 'fair use' as it applied to transformative works. However, after further review and considering arguments from various industry organizations like the Motion Picture Association and the International Documentary Association, the court concluded that 'Tiger King's' use of the clip was indeed transformative and served a different purpose than the original, aligning with interpretations from other circuit courts.

The revised judgment emphasizes the 'transformative' nature of the documentary's use of the footage, highlighting that the brief clip was integrated to convey a broader message within the documentary context, distinct from the original creator's intent. Furthermore, the court re-evaluated the impact of commercial success on 'fair use' claims, determining that while 'Tiger King' was a profitable venture, the short clip itself did not contribute materially to the commercial exploitation of the copyrighted material. This resolution effectively harmonizes the 10th Circuit's position with those of the 9th and 4th Circuits, offering a more consistent legal framework for documentary filmmakers across different jurisdictions.

This landmark decision reinforces the critical principle of fair use in creative endeavors, particularly for documentaries that often piece together diverse elements to construct a compelling narrative.
